Where can I find free legal advice on Immigration issues - my fiance is trying to move here to the US.?

My fiance is British (drives a recycling truck) we are planning to marry in May of 08. Things have changed drastically with the emmigration/immigration laws since 2001, I need help navigating what the legal jargon means from all the info we've received from the Embassy and the internet. First, I want to congratulate you on your engagement and also say thank you for going about this legally. I have nothing against immigrants who are here legally. I hope you and your future husband are very happy.





Your local bar association is a good source to start with. They can generally point you in the direction of legal aid or some other legal entity that gives free legal advise or can refer you to an attorney that may take your case pro bono. I used to work with an attorney who would help people with the immigration process for free (and I worked for a huge, fancy law firm with lawyers that charged $250 per hour). There are attorneys out there who will help.

To start the process, you need to file an I-129F known as the application for a Fiance Visa. This is where it all starts for bringing your Fiancee to the United States, Since he is English, he may be able to get a work visa and stay here while going through the process, but that can bring unwanted scrutiny to your case. There is nothing to stop him from coming here on a work visa and then getting married, but they can require him to return and obtain the proper visa documents which is very frustrating. The process for a fiance is extremely simple, and it has not changed in many years...It certainly has not changed since 2001.





There are just a lot of forms to fill out. You file an I-129 petition with a bunch of supporting documents. When it is approved, it is sent to the US embassy in London. Your fiance applies for a visa with a bunch of other supporting documents. He gets the visa, goes to the US, marries you within 90 days, and applies for a Green Card. You live happily ever after.
